IN NO EVENT SHALL GREEN LANTERN PIZZA'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO GREEN LANTERN PIZZA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some states do not allow the exclusion or limitation of certain damages. In such states, our liability shall be limited to the fullest extent permitted by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Green Lantern Pizza, its officers, directors, employees, agents, affiliates, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

11. Dispute Resolution

We will make good faith efforts to resolve the dispute within thirty (30) days of receiving your written notice of the dispute, which shall include a description of the dispute and your preferred resolution.

If the parties are unable to resolve the dispute informally within thirty (30) days, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be resolved by binding arbitration administered by a recognized arbitration institution in accordance with its then-current rules and procedures. The arbitration shall be conducted in English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND GREEN LANTERN PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.

11.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or other proprietary rights, without first engaging in the informal dispute resolution process or arbitration described above.

11.5 Consumer Rights

Nothing in this dispute resolution section shall limit your rights as a consumer under applicable federal or state law, including but not limited to any rights you may have under the Consumer Protection Act, the Federal Trade Commission Act, or applicable state consumer protection statutes. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA/CPRA) and other California-specific laws.

12. Term and Termination

These Terms are effective as of the date you first access our Site or use our Services and will remain in full force and effect until terminated by either party as provided herein.
